will your tax refund be taken even if your are paying (delinquent) child support as required. I mean there is a previous balance but you are paying it..

Yes.....girl my hubby was paying his child support as directed, but his ex accused him of not paying for the months that he gave her cash and he had no proof of payment (I tried to tell him not to do that and that it would come back to bite him in the @$$ but he did not listen). Oh, and if you buy extra things for the kids, it doesn't count toward child support. It is considered a "gift". They took his federal and state taxes.
